Other Misc. Rules Related to Firearms – Part 1
There are various other rules related to firearms, but as they don’t “fit” into the other categories that have been covered already. Below is half of the Other Miscellaneous Prohibited Acts.
- Firearm Identification – According to the DOJ, Penal Code, 23900, it is illegal for anyone to change or remove any of the identification marks that have been lawfully put on any firearm, which includes but is not limited to: make, model, serial number or any mark that has been lawfully added by the owner.
- Unloaded Handgun – Just as it is illegal to carry a loaded handgun, on a person or in a vehicle, while in or on:
- A public street in a section that has been prohibited of an unincorporated city or city and count.
- A public place or public street in an incorporated city or city and county
It is also illegal to carry an unloaded handgun.
- School Grounds – In the state of California it is illegal for any person who is not authorized to have/bring a firearm onto the grounds of, or into, any public school, which includes: the University of California, California State University campuses, California community colleges, any private school, K-12th grades or private university or college.
- Courtroom, State Capitol, etc. – Unless you are authorized to have a firearm in the following places, it is illegal to bring or have a firearm with you when you go into: a courtroom, courthouse, court building, or any meeting area that is required to be open to the public.
It is also illegal, unless you are authorized to have a firearm to have a firearm within the following places: the State Capitol, which includes the grounds, any legislative office, any office or residence of the Governor, any Senate or Assembly hearing room, or any residence of any Member of the Legislature or constitutional officer. In this case a firearm is considered loaded anytime the ammunition and the firearm are in the possession of the same person.
- Drawing a Firearm – Unless a person is defending themselves, it is illegal to show or draw an unloaded or loaded firearm in a threatening or angry way or in any way use a firearm in a fight.
- Public Street or Highway – Causing a person to fear for their safety, using an unloaded or loaded firearm, on a public street or highway is illegal.
- Discharging a Firearm in an Irresponsible Way – Willingly discharging a firearm in a negligent way, which could cause another person injury or death is illegal.
